General terms and conditions of sale
These terms and conditions of sale govern the sale and purchase of products marketed by TORMARESCA SOCIETA’ AGRICOLA A RESPONSABILITA’ LIMITATA IN SIGLA “VI.D.S. S.R.L. (hereinafter for brevity also referred to as “TORMARESCA” or “seller”) through the site www.tormaresca.it. All contracts for the purchase of products concluded between the seller and the Customer through the site www.tormaresca.it, according to the procedures indicated therein, shall be governed by these terms and conditions of sale in accordance with Italian law and in particular with Legislative Decree no. 70/2003 with regard to electronic commerce and Legislative Decree no. 206/2005 “cd. Consumer Code” with particular reference to the rules on distance contracts.
Any changes or new terms and conditions of sale will be promptly notified to the Customer and will be effective upon posting on the site and will apply only to sales completed after they become effective (by posting on the site).
Acceptance of terms of sale
The contract entered into between Tormaresca and the Customer shall be deemed to be concluded with the acceptance, even partial, of the order by Tormaresca. Acceptance shall be deemed tacit, unless otherwise communicated in any manner to the Customer at the contact details provided during the purchase process. By placing the order, the Customer declares that he/she has read the general conditions of sale set out below and that he/she has understood, shared and accepted them.
Mode of Purchase
The Customer may only purchase the products on the website www.tormaresca.it at the time of placing the order as described in the relevant descriptive and informative sheets.
Illustrative pictures referring to individual products are provided to the Customer to facilitate recognition of the same. In case of their variation due to changes in the packaging by the manufacturer, the photos may not exactly correspond to the appearance of the delivered product.
Correct receipt of the order is confirmed by Antinori through the forwarding of an email delivered to the email address provided by the Customer during the purchase procedure. This message will contain the date and time of receipt of the order and an “order number” which the Client must keep and which must be used in any further communication with Antinori. In the event that Antinori does not accept the order submitted, Antinori undertakes to forward, again by e-mail, an immediate communication to the Customer, to the address communicated by the Customer in the form. The prices of the products shown on the website www.tormaresca.it are intended as prices to the public and therefore include VAT.
Antinori reserves the right, at any time and without notice, to change prices by promptly updating the website. In the event that the price is published incorrectly on the website, Antinori reserves the right to abandon the sale.
Right of withdrawal: disclosure and procedure
In accordance with the provisions and regulations of the Consumer Code (Legislative Decree No. 206/2005) you may return the products free of charge within 14 working days of delivery of the purchased products.
To proceed with a return, simply send us an email to customercare@tormaresca.it indicating the following information:
- number and date of the order as listed in the confirmation email
- invoice number
- specify for which products the Customer intends to exercise the right of withdrawal (identifying them by item number)
- specify the reasons for the return
Our customer care department will within one business day email you all the instructions along with the waybill to conveniently proceed with the return.
The following conditions must be met to proceed with the return:
- the product purchased must be substantially intact: upon its arrival at Antinori, the product will be examined to assess any damage or tampering;
- the right of withdrawal is reserved only for natural persons, thus excluding purchases made by individuals who implement it as part of their professional activity.
Antinori undertakes to re-credit the sums by way of reimbursement in favor of the Customer within 14 working days of receipt of the returned products. The amount subject to refund will be equal to the value of the products indicated in the invoices.
Shipping and delivery
STANDARD SHIPPING – Free Delivery
Tormaresca delivers and ships its products, purchased on the site, through specialized couriers (DHL) Any shipping costs, indicated in the form of the purchase procedure, are your responsibility. upon receipt of the goods you are required to verify the integrity of the packaging. If you have any uncertainties regarding the integrity of the same, you must indicate this on the delivery receipt. In particular you are obliged to verify, at the moment of delivery, that: the number of packages corresponds to those indicated in the order; the packaging of the package (and of the packages) is intact, that is, not damaged or, in any case, altered; no other sealing materials other than those personalized “Antinori” have been used. Any disputes must necessarily be presented to the courier who proceeds with the delivery, making explicit that the collection is made with “reserve”. This evidence must be followed, absolutely within 8 days of delivery by e-mail, by a description and qualification of the “defects” or “alterations” of the packages, parcels, etc. Once the courier’s document is signed, you will no longer be able to oppose any dispute about the external characteristics of what has been delivered and therefore the sale will be perfected.
Please note that lead times include business days only: holidays (January 1, January 6, April 25, May 1, June 2, August 15, August 16, November 1, December 7, December 8, December 25, December 26) are excluded.
Payments
For payment of your orders placed on tormaresca.it you can choose from: Visa, Mastercard, American Express, Visa Electron.
When paying by credit card, you will be asked to enter your card information. To further ensure the security of the online transaction, you will need to enter your credit card security code:
- on American Express cards, the 4-digit security code is located on the front surface above the credit card number
- in Visa and Master Card cards, the 3-digit security code is located in the signature box on the back of the card
When you purchase on Tormaresca your payment is handled through an SSL 3 certified data encryption protocol. It is important for us to ensure the security of the online transactions made: for this reason, the data related to your credit/debit card (serial number, expiration date and security code) will be sent automatically and by secure protocol to the bank in charge of providing remote payment services, taking care to prevent any abusive or unauthorized access by third parties.
When you place your order, the total amount is reserved on your card. The actual payment, and thus the charge to your card, will occur only when the order is processed and the courier takes delivery
Payment is made directly on our bank’s server: at no time does Tormaresca have access to your credit card details.
The billing data will be the shipping data. You will be able to choose to enter data from a different billing address than the shipping address only within the same country.After the invoice has been issued, you will not be able to make any changes to the data shown on the invoice.
VAT is already included in the price you see on all pages of the site and in the Shopping Bag.
Please be advised that the invoice for your order, sold and shipped by www.tormaresca.it will be included in the package you receive at the shipping address provided.
In the case of return, a credit note will be issued.
